Action to recover upon an insurance policy against loss occasioned by and caused by burglary. The judgment dismissed the complaint
on its merits. Plaintiff owned a policy of burglary insurance issued by the defendant which was in effect on March 10, 1955. On that date
plaintiff's premises were burglarized. Practically no property was carried away but it was evident that an unsuccessful attempt
had been made to open the office safe. Desks, cabinets and other receptacles were ransacked and the contents strewed about.
Other property in the premises was damaged and destroyed by the burglar without any apparent rational purpose.
